CHARGESPOT PRIVACY NOTICE

1.              What does this notice cover?

This policy describes how INFORICH EUROPE LTD (also referred to as "Controller ", "we" or "us") will make use of your data when you use our services whether accessed through the physical CHARGESPOT battery stands operated by us (also referred as “Service”).

It also describes your data protection rights, including the right to object to some of the processing which Controller carries out. More information about your rights, and how to exercise them, is set out in the “Your choices and rights” section.

2.              Personal data we may collect about you

We collect and process personal data about you when you interact with us and when you purchase Services from us through our physical CHARGESPOT battery stands and when you use our Services and communicate with us.  This may include:

Communication Content	Your posts, photos, videos, comments, transaction messages, evaluations or ratings, responses to our surveys and other information you send to us
Call Recordings	Your voice and information about you recorded during phone calls you have with us

 

3.              How do we use this information, and what is the legal basis for this use?

We will only use your personal data for the purposes and legal bases set out below:

It is necessary for us to process your personal data in order to perform our contract with you, or to take steps at your request prior to entering into a contract with you.
We will collect, use and store your Identification Information, Contact Information, Usage Information, Communication Content and Call Recordings to manage our relationship with you, facilitate communication and to improve Service quality.	We have a legitimate interest in managing our business and relationship with the clients; providing high quality Services to our clients, resolve any issues with the Services and improving them.
We will collect and use Contact Information and Marketing Information to send you direct marketing in relation to Services provided by us or to invite you to take part in and manage customer surveys, reviews and other market research activities carried out by us and by other organisations on our behalf.	Our legitimate interest or your consent to receive direct marketing communication.   We have a legitimate interest to in building our marketing strategy and promoting our Services to our clients.
We will collect, use and store your Identification Information and Usage Information to complete our tax and financial obligations	We have a legal obligation, in particular under applicable tax law.
We will collect, analyse and store your Identification Information, Usage Information to resolve operational issues with Service and develop new Services and to improve or modify our existing Services. There are instances where we have a legitimate interest to use your data. Our legitimate interest will vary depending on what we are using your data for, and we explain above what the interest is and how it relates to the processing operations that we are carrying out. Where we process personal data on the basis of a legitimate interest, then – as required by data protection law – we have carried out a balancing test to document our interests, to consider what the impact of the processing will be on individuals and to determine whether individuals’ interests outweigh our interests in the processing taking place. 4.              How we share your personal data

We may share your data with the following categories of recipients:

-       Controller group companies - to operate, improve, and develop our services

-       Third party service providers - when we employ other companies to perform functions on our behalf. Examples include website and application hosting, responding to inquiries from customers, inquiries from us to customers, providing relevant after-sales services

-       Payment processing service providers to process payments

-       Courts, authorities, regulatory agency, or other public institutions if required by law or where necessary for the establishment, exercise, or defense of legal claims

5.              Where we transfer your personal data

Your personal data will primarily be stored on secure servers managed by third-party located in Germany. However, we may also transfer and store your personal data at a destination outside the EEA, due to the global nature of our business.

Your personal data may be transferred to the UK where our company is registered and to Japan where our parent company INFORICH INC.  (株式会社INFORICH) is located. These transfers are particularly for purposes of technical support or customer service.

According to the Adequacy Decisions from the EU Commission both the UK and Japan provide an adequate level of data protection, so we ensured that appropriate safeguards are in place to protect the transfer of your personal data to these countries.

6.              Your choices and rights

You have the following rights:

These rights may be limited, for example if fulfilling your request would reveal personal data about another person, or if you ask us to delete information which we are required by law or have compelling legitimate interests to keep.

Wherever we rely on your consent, you have the right to withdraw that consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal. We may however have other legal grounds for processing your data for other purposes, such as those set out above.

In some cases, we are able to send you direct marketing without your consent, where we rely on our legitimate interests.  You have an absolute right to opt-out of direct marketing, or profiling we carry out for direct marketing, at any time. You can do this by following the instructions in the communication where this is an electronic message, or by contacting us using the details set out below.

If you have unresolved concerns, you have the right to complain to a data protection authority in the country that you reside in or, the country of your place of work or the country where the alleged infringement took place.

If you do not provide us Identification Information and Contact Information we will not be able to conclude the contract with you and provide you our Services. The provision of other information is optional, however lack of these information might impact the way we are providing you our Service or the accessibility of these Service.

7.               How long we retain your personal data

We will retain the personal data for as long as necessary to fulfil the purposes for which it was collected, as described in this notice and in accordance with applicable laws and regulations. We will erase, destroy, or anonymize the personal data once it is no longer needed for these purposes, or if it becomes irrelevant or unnecessary for the purposes of collection.

We reserve the right to update this privacy notice at any time, and we will provide you with a new privacy notice when we make any substantial updates. We may also notify you in other ways from time to time about the processing of your personal information.
