- Terms of Use in Italy
Effective Date: September 5 , 2025
Please be informed that by accessing and using the ChargeSPOT services provided by INFORICH EUROPE LTD, a private Company incorporated in England with its registered office at 16 Great Queen St, Covent Garden, London WC2B 5AH United Kingdom (the "Company"), you (hereinafter also referred as to “Customer/s”) agree to this Terms of Use, Privacy Policy, and all other rules stated on our website.
Article 1 (Contractual Relationship)
1. These Terms of Use (hereinafter referred to as "Terms") apply when you use the products provided by the Company, which include battery-powered units that Customers can rent from ChargeSPOT battery stands for charging their personal electronic devices (“Portable Chargers”), emergency cables and other accessories. These Terms also apply to ChargeSPOT battery stands for storing, lending, returning, and charging portable chargers (collectively referred to as the “Spot") and related services as described hereinafter.
The “Service” consists of a technology platform that enables Customers to use a physical kiosk tap model, where Customers interact with the on-screen interface and pay directly via the kiosk without registering an account.
2. You must be 18 years old, or the minimum age required in your country to access the Service. If you are under the legal age of majority in your place of residence, you must have your parent or legal guardian’s permission to use the Service.
3. The Company reserves the right to change these Terms at any time. Such changes will become effective when posted on our website. Whenever you use the Service, you accept the version of the Terms in force at that time.
Article 2 (Management of the Service)
1. Service Description
The Service is available for personal, non-commercial use only. When using the Service, you must comply with the provisions outlined below.
2. Ownership of Rights
The Service and all associated rights, including but not limited to the following, are and shall remain the exclusive property of the Company:
(i) All rights related to the Service, except for the rights to use the Service under these Terms.
(ii) The Company's trade names, logos, products, service names, trademarks, or service marks.
3. Maintenance
The Company bears responsibility for the operation, maintenance, and repair of the Spot and Portable Chargers. However, it does not guarantee the absence of issues with all available Spots or Portable Chargers at any given time.
You must examine the integrity and performance of the components before using Portable Chargers and ensure you understand the functionality of chargers and safety precautions.
If you discover a malfunctioning Portable Charger, you must stop using the Portable Charger and notify the Company.
You assume responsibility for the consequences of continuing to use damaged Portable Chargers.
Article 3 (Use of the Service by Customers)
1. Handling of Portable Chargers
Before and during the use of a Portable Charger, you must adhere to the following provisions:
(i) Carefully inspect the Portable Charger you wish to rent to ensure it is in good working condition before use.
(ii) Test the operating components of the Portable Charger (including but not limited to the Portable Charger itself and charging cables) before intended use.
(iii) Promptly contact the Company's customer service to report any defects, malfunctions, or the need for repairs involving the Spot or Portable Charger.
(iv) In the event of theft of the Portable Charger, immediately notify both the Company and the local police.
2. Charging Status of Portable Chargers
You can rent only Portable Chargers stored in the Spot that are sufficiently charged.
However, you may rent Portable Chargers that are not fully charged in urgent situations, provided you agree in advance to the conditions below:
- The Company does not guarantee that partially charged Portable Chargers will meet your expectations regarding quality, performance, continuous use, or defect-free operation.
- You will not request the provision of a fully charged Portable Charger, a reduction or refund of usage fees, damages compensation, or raise objections against the Company, if the Portable Charger fails to provide the charging capacity you need for your devices.
3. Prohibited Actions
You are prohibited from engaging in the following actions when using the Portable Charger or interacting with the Spot. Any violations will be prosecuted by the Company through all means available under applicable law.
(i) Removing any copyright, trademark, or proprietary notices from any part of the Spot or the Portable Charger.
(ii) Reproducing, modifying, distributing, licensing, renting, selling, reselling, transferring, publicly displaying, publicly performing, transmitting, streaming, broadcasting, improperly using any part of the Service, creating derivative works based on the Spot or the Portable Charger, or performing similar actions on such derivative works without prior explicit consent from the Company.
(iii) Reverse engineering, decompiling, or disassembling the Spot or the Portable Charger except where permitted by applicable law.
(iv) Running any programs or scripts intended to extract, index, survey, or data mine any parts of the Spot or disrupt the operation or functionality of the Service.
(v) Attempting to gain unauthorized access to or interfere with any part of the Service, including systems or networks related to the Service.
(vi) Transferring or attempting to transfer the Spot or Portable Chargers.
(vii) Listing the Spot or Portable Chargers on internet auction sites or flea market platforms.
(viii) Violating laws, regulations, or these Terms.
(ix) Engaging in actions that infringe on the rights of the Company, other Customers, or third parties.
(x) Using the Service through illegal or fraudulent means.
(xi) Utilizing the Portable Charger without paying the Service fees.
(xii) Engaging in any other behavior deemed inappropriate by the Company.
Article 4 (Service Usage Period, Usage Fee and other costs)
1. Usage Period
The rental period for the Portable Charger begins when it is unlocked ("Rental Start Time") and ends when the Portable Charger is returned to the Spot.
You are required to pay the usage fees specified in section 3 below (“Usage Fees”) based on the rental period ("Pay-as-You-Go Service").
The rental period cannot exceed 48 hours. If a Portable Charger is not returned within 48 hours of the Rental Start Time, you shall pay a penalty fee of EUR [30] (including any applicable tax) in addition to the Usage Fees, as specified in the following section.
2. Security Pre-Authorization
The Company shall place a pre-authorization hold of Euro [30] on the credit card used for the transaction as security for the proper use and return of the Portable Charger.
The pre-authorization hold will be automatically released once the Portable Charger is returned to the Spot in proper condition. The actual reimbursement of the pre-authorization hold may take several days depending on the Customer's banking institution.
In case of return after 48 hours or more, the pre-authorized amount will be charged to the card and retained by the Company.
3. Usage Fees
By using the Service, you agree to pay the Usage Fees for the Portable Chargers as outlined below:

4. Other Costs
You are responsible for any expenses incurred to rent or return Portable Chargers from the Spot, regardless of the reason. This includes, but is not limited to, transportation costs to and from the Spot location and communication costs for searching for the Spot's location.
You agree not to make any claims for reimbursement of these costs from the Company.
5. Changes to Usage Fees
The Company reserves the right to change at any time the Usage Fees and the penalty fees described in Article 11 below, which will be deemed accepted each time you use the Service.
Article 5 (Payment)
1. Payment Method for Usage Fees
By using the tap model you shall pay directly at the kiosk by credit card or by any other payment method made available at the kiosk.
Article 6 (Covenants)
1. You agree to maintain Portable Chargers with prudent care and agree to comply with the following obligations during their use:
(i) You declare to fully understand that contact of the Portable Charger with water, exposure to fire, and disassembly of the Portable Charger create risks of accidents and agree to exercise proper caution to avoid such accidents.
(ii) You agree to use and operate the Portable Charger with care and in a careful, reasonable, and adequate manner.
(iii) You agree to not dispute that all Portable Chargers always remain exclusive property of the Company at all times.
(iv) You agree to return the Portable Charger in its original condition to the Spot where you rented the Portable Charger or to another Spot available.
Article 8 (Limitations of Liability)
1. The Company undertakes to provide the Service in compliance with applicable laws and industry standards.
2. The Company will be liable for damages suffered by the Customer in relation to the Service arising from (i) its intentional misconduct, ii) its gross negligence, or iii) in case of death or personal injury of the consumer resulting from an act or omission of the Company.
3. If you cause damage to or injure your own property or third-party property or persons while operating or possessing the Portable Charger, you shall bear sole responsibility for such damage or injury.
4. You are responsible for all damages and costs resulting from improper use or misuse of Spots or Portable Chargers.
5. Even if the Company elects to use insurance related to the operation of Portable Chargers, you remain solely responsible for any legal liability, property damage, personal injury, injury to third parties, damages, penalties, fines, losses, or any incurred expenses of any kind related to the improper use of Portable Charger or caused by circumstances beyond Company’s reasonable control. It remains understood that Company is not obligated to provide any type of insurance related to the Customer’s use of Portable Chargers.
Article 9 (Jurisdiction and Governing Law)
1. These Terms shall be governed by and interpreted in accordance with Italian law. Any disputes related to the use of Portable Chargers or the Spot or these Terms shall fall under the jurisdiction of the competent consumer court under the Italian Consumer Code.
Article 10 (Indemnity)
1. You agree to defend, indemnify, and hold the Company harmless from all claims made by third parties that arise from your violation of these Terms, or from your use or operation of Spots or Portable Chargers.
2. When third-party claims arise, the Company may, at its discretion, require the Customer to take responsibility for defending and resolving such claims. In these cases, you will be responsible for handling and resolving the claims while still fulfilling the obligation to indemnify the Company. The Company reserves the right to take over the defense and resolution of any such claims at any time.
3. You must obtain written consent from the Company before settling or resolving any third-party claims.
Article 11 (Penalty Fees)
1. If you, intentionally or negligently, cause damage, destruction, staining, or loss of the Portable Charger, resulting in damages to the Company, you are responsible for compensating the Company for all incurred damages (including reasonable attorney fees).
2. If you, intentionally or negligently, cause a Portable Charger to become unusable due to damage, destruction, staining, or loss during its use, you shall pay compensation of EUR [30] (included any applicable tax) to the Company (“Penalty Fees”). However, if the damages incurred by the Company exceed the Penalty Fees, the Company reserves the right to demand payment for the amount exceeding the Penalty Fees.
3. In case of damage to the Portable Charger upon return, the pre-authorization hold placed under Article 4.2 will be charged to cover the Penalty Fees up to the pre-authorized amount. If damages exceed the pre-authorized amount, you shall be liable for the additional costs.
4. The pre-authorization hold will be automatically released once the Portable Charger is returned to the Spot in proper condition. The actual reimbursement of the pre-authorization hold may take several days depending on the Customer's banking institution.
5. In case the Portable Charger is damaged upon return, the pre-authorization hold will be retained by the Company.
Article 12 (Non-Waiver of Rights)
1. If the Company does not enforce any provision of these Terms in a particular situation, this does not mean the Company will not enforce that provision or any other provision in the future. The Company’s past conduct or business practices with the Customer does not change any part of these Terms. If the Company waives its rights in a specific instance, this does not prevent the Company from enforcing its rights for any future violations of these Terms.
Article 13 (Protection of Personal Information)
1. The Company may use the personal information provided by Customers to the extent necessary to provide the Service and for purposes outlined in the Company's privacy policy (“Privacy Policy”). Customers agree that the Company will handle personal information according to the Privacy Policy. The Privacy Policy can be reviewed at the following URL: https://eu.chargespot.global/en/privacy
Article 14 (Customer Support)
1. If you encounter any problems while using the Service or wish to provide any communication to the Company, you can contact the Company by sending an email at chargespot.support.it@inforicheurope.com.
2. Any communication costs incurred when reporting issues or contacting the customer support center, including email charges and call fees, shall be borne by you and you shall not claim these costs from the Company.
Article 15 (Miscellaneous Provisions)
1. You may not assign or transfer your status, rights, or obligations under these Terms in whole or in part without prior written consent from the Company. Without prejudice to your rights, the Company, however, may transfer or assign its status, rights, or obligations under these Terms in whole or in part to the following entities:
(i) Subsidiaries or affiliates,
(ii) Purchasers of the Company's equity, business, or assets, or
(iii) Successors through mergers.
2. The contractual relationship between you and the Company, or the use of the Service, does not constitute a joint venture, partnership, employment, or agency relationship between the Customer and the Company.
3. If any provision of these Terms, in whole or in part, is deemed illegal, invalid, or unenforceable under applicable law, that provision or part thereof shall be considered severed from these Terms to the extent necessary. This does not affect the legality, validity, or enforceability of the remaining provisions.
In accordance with Article 1341 and 1342 of Italian Civil Code, you declare that you expressly approve each of the following clauses, having carefully considered their scope and consequences:
